Terms of Service

Effective Date: 19.8.2025

These Terms of Service (“Terms”) govern your use of the motorsport telemetry analysis service (“Service”) provided by Sorsa Dynamics Oy, a company incorporated in Finland (“Company”, “we”, “us”, “our”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

Eligibility

You must be at least 18 years old and legally capable of entering into binding contracts under the laws of your country of residence to use the Service.

User Content

Definition. “User Content” means all data, files, telemetry logs, images, video, or other materials you upload, submit, or provide to the Service.
Assignment of Rights. By uploading or submitting User Content, you irrevocably assign and transfer to Sorsa Dynamics Oy all rights, title, and interest in and to such User Content, including all intellectual property rights, worldwide and for the full duration of those rights.
Moral Rights. To the maximum extent permitted by applicable law, you waive any moral rights (such as rights of attribution or integrity) in relation to User Content.
Use of Content. Sorsa Dynamics Oy may use, copy, modify, adapt, distribute, display, analyse, and commercialise User Content for any purpose, without obligation of notice, attribution, or compensation to you.
Responsibility. You represent and warrant that you have all necessary rights and authority to provide the User Content and to assign the rights described in this section.

Service and Intellectual Property

All software, code, features, designs, and materials forming part of the Service are owned by or licensed to Sorsa Dynamics Oy and are protected by Finnish, EU, and international intellectual property laws. Nothing in these Terms transfers any rights in the Service to you.

Data Storage and Hosting

The Service is hosted on Google Firebase Cloud. While we use commercially reasonable measures to secure and maintain the Service, Sorsa Dynamics Oy does not guarantee uninterrupted availability, security, or that User Content will always be retrievable.

Prohibited Use

You agree not to use the Service to:

Upload unlawful, infringing, or harmful content.
Upload content containing malware, viruses, or harmful code.
Reverse-engineer, copy, or attempt to disrupt the Service.
Use the Service in a manner that could impair its performance or accessibility for others.

Disclaimers

The Service is provided “as is” and “as available.” To the fullest extent permitted under EU law, Sorsa Dynamics Oy disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

To the maximum extent permitted under Finnish and EU law, Sorsa Dynamics Oy shall not be liable for:

Indirect, incidental, special, or consequential damages,
Loss of profits, data, or business opportunities,
arising from your use of or inability to use the Service.

Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.

Indemnification

You agree to indemnify and hold harmless Sorsa Dynamics Oy, its affiliates, employees, and contractors from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your User Content or your breach of these Terms.

Termination

Sorsa Dynamics Oy may suspend or terminate your access to the Service at any time, with or without cause, and without prior notice. Upon termination, we may delete User Content at our discretion.

Governing Law and Jurisdiction

These Terms are governed by the laws of Finland. Any disputes shall be subject to the exclusive jurisdiction of the Finnish courts, with the District Court of Helsinki as the court of first instance.

Amendments

Sorsa Dynamics Oy reserves the right to amend these Terms at any time.

Updated Terms will be posted on the Service.

Continued use after posting constitutes acceptance of the amended Terms.
